BlueBeat.Com Ordered To Remove Beatles Songs from Its Download Site

Los Angeles – Judge John Walter of the U.S. District Court of the Central District of California approved a temporary restraining order prohibiting BlueBeat.com from selling the Beatles’ songs via the download site.

The restraining order issued November 5, 2009 came after EMI, the record label owning the rights to the Beatles’ songs,  issued an injunction against the site this week after learning that it is selling the songs for 25 cents USD each and allows users to stream the songs for free.

EMI’s lawyers stated that the site was engaged in digital music piracy and was destroying a legitimate digital market. The lawsuit makes particular mention of the Beatles tracks.

“Although Defendants claim, without any evidence, that an injunction would significantly harm, if not destroy, their business the hardships suffered by Plaintiffs will be great if Defendants are not enjoined from infringing or misappropriating Plaintiffs’ Recordings,” Judge Walter ruled. “Defendant cannot invalidate the copyright of an independent and preexisting sound recording, simply by incorporating that recording in to an audiovisual work.”

Since BlueBeat was the first online site to offer the Beatles’ songs for online consumers, this means that sales of the popular songs through the site will stop and fans wanting to get a copy would have to wait for the rumored official release of the complete Beatles’ discography along with the remastered album this fall. However, there is still no news about who will be selling the digital songs since Sir Paul McCartney recently revealed that a bid to get the songs on iTunes had “stalled”.
